Canadian annual fee calculation method
(1) Patent validity period: (patents applied after October 1, 1989) are 20 years from the application date (before October 1, 1989, it was 17 years). PCT patents are calculated from the date of PCT application.
(2) Industrial design validity period: 10 years from the date of design registration or 15 years from the date of filing application, whichever is later is the expiration date. The maintenance period starts 5 years after the design registration date. The maintenance fee must be paid within 5 years from the registration date. If it is not paid, it must be paid together with a late fee within 6 months after the end of the 5-year period. If it is not paid after 6 months, The period shall be deemed to have expired.
(3) For example: For example, if the application date of a patent is July 14, 1995, the annual fee for the second year should be paid before July 14, 1997. For example, the standard fee is US$100. When querying the payment information, Anniversary Year One column is shown as 2 (it should be noted that it is different from the annual fee mark in India.
