Macau, China Annual Fee Calculation Method
(1) Calculated from the date of application (the date of application for a Macao patent if it has priority), the annual fees for the first two years of new model patents and the first three years of invention patents are included in the annual fees of the first five years of design and new model patents. There is no need to pay additional fees within the application fee; each subsequent fee needs to be paid within six months before the expiration date of the previous year (fees must be paid for registration or non-registration), and additional fees must be paid together with additional fees if paid within six months after the expiration of the validity period. Otherwise, the industrial property rights will become invalid.
(2) For example: The application date for an invention patent is April 28, 2016, then the expiration date of the third year (the payment deadline for the fourth year annual fee) is April 28, 2019. In October 2018, There is no need to pay the annual fee for the first three years before October 28, 2018. The fourth year's annual fee of MOP 500 needs to be paid between October 28, 2018 and April 28, 2019. When checking the annual fee status on April 29, 2021 The annual fee has been paid for 6 years. There is no need to pay the annual fee before October 28, 2021. April 28, 2022 is the deadline for paying the annual fee for the seventh year, which needs to be between October 28, 2021 and 2022.
